The Appeals Chamber is competent to remit sentencing to a Trial Chamber to be designated by the President of the Tribunal. |
The Appeals Chambers Judgment of 15 July 1999 found Dusko Tadic guilty of counts on which he had been acquitted by the Trial Chamber1. The Appeals Chamber considered that it is sufficient for it to decide that it to can remit sentencing to a Trial Chamber to be designated by the President of the Tribunal2. In the circumstances of the case, it prefers to do so rather than to pronounce sentences itself.
