Milosevic and others case: warrants re-issued to the Federal Republic of Yugoslavia.

 

On Monday, 22 January 2001, Judge David Hunt re-issued warrants of arrest to the Federal Republic of Yugoslavia for the surrender of Slobodan Milosevic, Milan Milutinovic, Nikola Sainovic, Dragoljub Ojdanic and Vlajko Stojilkovic.

The indictment and warrants of arrest were initially issued against the above-named accused on 24 May 1999 and transmitted to the then Federal Minister of Justice of the Federal Republic of Yugoslavia, all United Nations Member States and the Confederation of Switzerland (see Press Release JL/PIU/403-E, 27 May 1999).

Considering General Assembly resolution 55/12 of 10 November 2000 approving the Federal Republic of Yugoslavia’s application for membership of the United Nations and in view of an application by the Prosecutor, dated 22 January 2001, Judge Hunt re-issued the warrants of arrest and orders for surrender with the inclusion of a direction that the Federal Republic of Yugoslavia make enquiries to discover whether the above-named accused have "assets located in its territory and, if so, adopt provisional measures to freeze such assets, without prejudice to the rights of third parties, until the accused are taken into custody".

Judge Hunt further considered that, "in accordance with Security Council resolution 827, the Federal Republic of Yugoslavia is obliged to co-operate fully with the International Tribunal and to comply with any orders issued under Article 29 of the Statute".
