KRSMANOVIC CASE-IT-96-19-MISC1-UPDATE 1


Responding to the application filed by counsel for Colonel Aleksa KRSMANOVIC on 19 March 1996, requesting clarification of the Colonel's status, the Prosecutor stated that:


- Colonel KRSMANOVIC has indicated that he "is not prepared to co-operate with the Prosecutor and . . . is not prepared to be a witness before the Tribunal";


and that


- " the evidence presently available to him does not disclose a prima facie case of the commission of any offence falling within the jurisdiction of the Tribunal".


The Prosecutor thus submits that:


- "the presence of Colonel KRSMANOVIC in the Hague is no longer necessary and, pursuant to Rule 90 bis (E), Colonel KRSMANOVIC should be remanded to the authorities of Bosnia and Herzegovina".


Upon notification of this response on 27 March 1996, in an additional application filed the same day, Mr. Igor PANTELIC, counsel for Colonel KRSMANOVIC, requested Judge JORDA to order the "immediate and unconditional release" of Colonel KRSMANOVIC by 29 March 1996.


Colonel KRSMANOVIC's applications and the Prosecutor's response will be heard by Trial Chamber I, presided over by Judge JORDA, this morning at 10.30 a.m.
