ALEKSOVSKI CASE UPDATE: ACCUSED SEEKS SEPARATE TRIAL AND CHALLENGES THE FORM OF HIS INDICTMENT


In a motion filed on 19 June 1997, the accused Zlatko Aleksovski seeks an amendment of his indictment and a separate trial from his co-accused in the indictment (Kordic & Others ("Lasva River Valley area")).




I. Form of the Indictment


The accused requests the trial Chamber to "order the Prosecutor to supply a sufficient description of the relevant conduct of the accused in connection with the specific elements constituting a crime as meant in the indictment", and "add to the individual charges a precise description of the place, time and manner of execution of the alleged crime and, above all, persons
involved".



II. Separate Trial


In his motion, the accused also seeks to be severed from his 4 co-accused in the indictment, issued on 10 November 1995, and tried separately, "to avoid a possible conflict of interests and to protect the interests of justice". The accused's right to be tried without undue delay can only be protected if he is tried separately, he claims.


The accused seeks a ruling from the Trial Chamber that he be tried separately to protect the interests of justice.
