Prlic And Others To Remain In Detention Unit

The Appeals Chamber on 11 March 2008 overturned last month’s decision by Trial Chamber III that granted provisional release to five of the six accused in the Prlić and others case.

Jadranko Prlić, Bruno Stojić, Slobodan Praljak, Milivoj Petković and Valentin Čorić will therefore remain in the Tribunal’s Detention Unit during the break in trial proceedings.

The Appeals Chamber found that the “various justifications for release offered by the accused are not sufficiently compelling, particularly in light of the 98bis Ruling” to warrant their provisional release.

The decision further states that when reaching its decisions of 19 February 2008 the Trial Chamber failed to “explicitly discuss the impact of its 98bis Ruling when granting provisional release”.

In rendering its 98bis ruling on 20 February 2008, the Trial Chamber said that there was a case to answer for all of the accused and that there was clear evidence supporting the Prosecution case that all of the accused participated in a joint criminal enterprise during the period covered by the indictment.

The accused are former high-level leaders of the Bosnian Croat wartime entity Herceg-Bosna and are on trial for their alleged responsibility for war crimes committed against Bosnian Muslims and other non-Croats from areas in southwestern and central Bosnia and Herzegovina during 1992 and 1993.
