CELIBICI CASE:


TRIAL CHAMBER ISSUES AN ORDER RELEASING ESAD RAMIC

FROM THE SUBPOENA AD TESTIFICANDUM


On Thursday 23 October 1997, Trial Chamber II bis (consisting of Judge Karibi-Whyte, presiding, Judge Odio Benito and Judge Jan) issued an Order on the Prosecution’s Oral Request for the Release of Esad Rami} from the Subpoena ad testificandum issued by the Trial Chamber.


Mr. Ramic was subpoenaed by the Trial Chamber, on 15 October 1997, to appear before it on 22 October 1997, following a request by the Prosecution to that effect (see PR 249).


Mr. Rami} appeared in The Hague in compliance with the Subpoena ad testificandum and stated his willingness to testify. However, an oral request made by the Prosecution on 23 October, that the Trial Chamber release Mr. Rami} from the subpoena on the grounds that his testimony "is unnecessary at this time", was granted the same day in the above order.


KOVACEVIC CASE:

FRIDAY’S PRELIMINARY MOTION HEARING POSTPONED SINE DIE


1. Pursuant to a Scheduling Order issued by Trial Chamber II (consisting of Judge Stephen, presiding, Judge Karibi-Whyte and Judge Jan) on 28 October 1997, the preliminary motion hearing scheduled for Friday 31 October 1997 has been postponed sine die as medical reports concerning the health of Mr. Kova~evi} have not yet been completed. These reports were to be
examined by the Trial Chamber in its consideration of the Defence application for provisional release.


In the order, the Trial Chamber instructed the parties to advise the Trial Chamber once the medical examinations of the accused have been completed and reports obtained. The Trial Chamber will set a new date for hearing the matter.


During the preliminary motions hearing of 10 October 1997, Defence Counsel for the accused and the Prosecution had agreed that medical tests should be carried out on Mr. Kovacevic in order to verify the Defence’s allegation that his health was failing and that, as a result, he should be provisionally released (see PR 248).


2. On 27 October 1997, following a request by Mr. Kovacevic, the Registrar of the Tribunal withdrew the assignment of Mr. Anthony D’Amato as lead counsel with effect from 27 October 1997, and appointed Mr. Dusan Vucicevic as lead counsel.
