Magdalena Spalińska, Spokesperson for Registry and Chambers, made the following statement:
President Meron last week appointed Judge Sekule to the Bench of Appeals Chamber to decide on the Prosecution’s request for reconsideration of the Appeals judgement in the case of Momčilo Perišič. The Prosecutor had submitted this request claiming that cogent reasons exist to correct “a manifest miscarriage of justice to the victims in the rare and exceptional circumstance of the case”.
Before the Appeals Chamber of the MICT, Milan Lukić filed an application for review of the Trial Chamber judgement claiming new evidence in the case. In his motion, Lukić cites statements from four witnesses allegedly bringing forth new facts regarding the Drina River, Pionirska Street, Bikavac and Varda factory incidents.
In the Stanišić and Župljanin case, Acting ICTY President in the case, Judge Agius appointed a panel of three judges, Judges Flügge, Morrison and Baird to consider the joint Defence motion for recusal of Judge Liu from adjudication of motion to vacate the Trial Chamber judgement. In October last year, Zupljanin filed this motion following the disqualification of Judge Harhoff from the Šešelj case. As Judge Harhoff was also a member of the Bench in his case, Župljanin claimed that his right to a fair trial was violated because of the participation in the trial judgement of a judge “infected by actual, or engendering an apprehension of, bias”. Both accused claim that Judge Liu who dissented from the majority decision to disqualify Judge Harhoff "is therefore not in a position to adjudicate the Motion to Vacate without being predisposed to a particular outcome".
Onto the courtroom activities, hearings in the trial of Radovan Karadžić continue this week and next as scheduled. The testimony of Gojko Kličković, former President of the War Presidency in Bosanska Krupa as well as the Prime Minister of Republika Srpska, is now concluding. He is the 230th witness to be called by the Defence.
