Refik Hodžić, Spokesman for Registry and Chambers, made the following statement:
President Pocar, Registrar Holthuis and other ICTY officials returned from New York where they took part in the expert group meeting on the legacy of ICTY and other international tribunals. The discussions focused on two main issues: the form of residual judicial mechanisms to remain in place following the closing of the tribunals and the administration of archives. The discussions on the residual judicial mechanisms focused on their envisaged functions, including possible trials of fugitives, commutations of sentences of convicted persons, review of cases, witness protection and monitoring of referred cases. The focus of the debate on the ICTY archives was on its accessibility to the courts and the general public, especially that of the region of former Yugoslavia. It was agreed that ICTY and ICTR will prepare a report outlining various aspects of issues related to legacy and forward it to the UN Security Council.
The courtrooms are busy this week with the commencement of the Haradinaj et al. trial on Monday. This now brings the total to five on-going cases currently sitting in the courtrooms.
After receiving confirmation from a medical report on the health of SeSelj, the pre-trial judge has ordered that a status conference to be held on Tuesday 13 March at 16:00 in courtroom I.
Also in courtroom I next week, closing arguments will be held for the MrkSić et al. trial beginning Wednesday 14 March until 16 March beginning at 2:15 p.m.
Yesterday, the Trial Chamber affirmed its previous decision determining Separović was in conflict of interest and no longer eligible to represent the accused Markač. The chamber ordered that Markač immediately engage new counsel and that Separovic assist the new counsel in the handover process. The new counsel should then inform the Trial Chamber by 30 March on how much time would be needed to fully take over the case.
You will also all be aware that a modified joinder indictment was filed in the Gotovina et al case yesterday in accordance with Rule 73bis. The modified indictment reduces the scope of the indictment as ordered by the Trial Chamber in its order of 21 February.
The Prosecutor, Carla del Ponte, is in New York today and tomorrow. She is participating in a roundtable discussion on the prosecution of gender crimes. This event has been organized in connection with international women’s day tomorrow.
Asking for more details on the discussions which took place during the expert group meeting, a journalist wondered if there was more information on the options discussed in particular with reference to the trial of fugitives and the archives. Hodžić stated that decisions on these matters would be made in the future. The Tribunal remains of the position that remaining fugitives would be tried at the ICTY. In view of this, different mechanisms were discussed including the ways to downsize the Tribunal gradually to an organization which could deal with the trials of the remaining fugitives, even once all scheduled trials have been completed in line with the completion strategy. Hodžić made it clear the Tribunal still expected all fugitives to be tried within the current mandate. However, capacity had to remain in place for fugitives to be tried should they not be apprehended within the time frame of the Tribunal as laid out in the completion strategy.
Hodžić further stated that this would impact on the archives as the archives had to be accessible for trials: they had to be available in a form that would enable them to be used during the trials of the fugitives. The focus of the discussion on the archives was on their accessibility to the court and to the general public of the region especially.
