Office of the Prosecutor:
Olga Kavran, Spokesperson for the Office of the Prosecutor, made the following statement:
The Prosecutor was in Brussels on Tuesday, 26 June. She went there at the invitation of the Committee on Foreign Affairs and the Delegation for relations with the countries of South-East Europe of the European Parliament and took part in the exchange of views with the European Parliamentarians on the subject of ICTY's experience and transition from the international prosecution of war crimes to the promotion of judicial co-operation in South East Europe. The Prosecutor initiated the debate by speaking about the challenges, achievements and lessons learned in the Office of the Prosecutor since 1993. She also provided an update on the implementation of the Completion Startegy as well as on the issues of cooperation with states in the region and beyond. The Prosecutor provided detailed information on progress in cooperation with the national prosecutors in Bosnia and Herzegovina, Croatia and Serbia, and the OTP’s efforts to promote better cooperation between national prosecutors.
The Prosecutor is in Strassbourg today. She is there at the invitation of Mr. René van der Linden, the President of the Parliamentary Assembly of the Council of Europe where she delivered an address this morning.
In her speech, the Prosecutor expressed her appreciation for the work conducted by the Committee for Legal Affairs and Human Rights, and its rapporteur Mr. Tony Lloyd, as well as the comprehensive report he has prepared on the "Prosecution of Offences within the Jurisdiction of the International Criminal Tribunal for the former Yugoslavia", which was the subject of today’s discussion at the Assembly.
The report clearly identified the main issues in the work of the Office in the Prosecutor (OTP).
Carla Del Ponte continued by directly addressing some the most relevant points – cooperation with the Office of the Prosecutor, the transfer of cases and investigation files to domestic authorities of the former Yugoslavia as well as issues of regional cooperation.
You can read more about it in the press release.
Questions:
Asked if the Prosecutor has intentions of continuing for a few months after her mandate ends in September to acquaint the new Prosecutor with his or her position, Kavran said that the Prosecutor has placed herself at the disposal of the UN in this respect but there has been no formal decision yet taken. Kavran added that it would require authorization from the Swiss government and a decision from the UN Security Council. We have seen neither of these officially, so it was now in the stage of speculation. However, the Prosecutor has expressed her willingness to stay on until the end of the year if so required, said Kavran.
A journalist asked if the Prosecutor intended to recommend a successor or if she had a preference since she hinted in her speech before the Security Council that she would prefer continuity, and at the same time several NGOs from the former Yugoslavia suggested that her Deputy would take over. Kavran confirmed that the Prosecutor said she believed continuity was essential but added that she could not speak about the Prosecutor’s preferences since it was a decision for the Security Council to take. Therefore, it would be a question for the Security Council, not for the Prosecutor.
Asked if the Secretary General has sought the Prosecutor’s advice on the matter, Kavran stated that she did not know.
