BLASKIC CASE: FULL TRIAL CHAMBER II TO SIT ON 16 APRIL 1997 HEARING CONCERNING PROSECUTOR'S SUBPOENAS


In an order dated 14 March 1997, Judge Gabrielle Kirk McDonald directed that the hearing on the issuance of Subpoena Duces Tecum, scheduled for 16 April 1997, should be held before Trial Chamber II, and not a single Judge, "considering the significance of the issues to be addressed."


The full Chamber will be composed of Judges McDonald, Odio-Benito and Jan.


In her order, Judge McDonald invites request for amicus curiae briefs on the following questions by 7 April 1997:

the power of a Judge or Trial Chamber of the International Tribunal to issue a Subpoena Duces Tecum to a sovereign State; the power of a Judge or Trial Chamber to make a request or issue a Subpoena Duces Tecum to a high government official of a State; the appropriate remedies to be taken if there is non-compliance with a Subpoena Duces Tecum or request of a Judge
or Trial Chamber.
