Enforcement of Sentences

Persons convicted of crimes by the Tribunal do not serve their sentence in the ICTY’s Detention Unit, as it is not a penitentiary. Sentences are served outside the Netherlands in a state that has signed an agreement on enforcement of sentences with the ICTY. This map indicates the states that have signed an agreement with the ICTY, including those where no convicts have been transferred to date. The list of accused does not include those whose sentences amounted to the time spent in detention during trial.
Enforcement
 
As of 2011, 17 states have signed an agreement. The Tribunal’s President determines the state where a convict will be transferred, on the basis of the Registrar’s preliminary enquiry into which state is prepared to enforce the sentence. The President may consult the Sentencing Chamber, the convicted person and the Office of the Prosecutor before making a decision. Particular consideration is given to the proximity of the proposed state to the convicted person’s relatives.
