Referral Bench of the ICTY Decides to Refer the Gojko Jankovic Case to Bosnia and Herzegovina

 

 

Today, 22 July 2005, the Referral Bench of the ICTY issued a Decision to refer the case against Gojko Jankovic to the authorities of Bosnia and Herzegovina.

On 29 November 2004, the Prosecutor filed a Motion for Referral in the case of Gojko Jankovic and Dragan Zelenovic. A hearing by the Referral Bench took place on 12 May 2005 with representatives of the Governments of Bosnia and Herzegovina and of Serbia and Montenegro. For practical purposes, the Referral Bench restricted its consideration of the Motion for Referral to the Accused who is in the custody of the Tribunal.

The Bench concluded that:

" having considered the matters raised, in particular the gravity of the criminal conduct alleged against the Accused in the present Indictment and the level of responsibility of the Accused, and being satisfied on the information presently available that the Accused will receive a fair trial and that the death penalty will not be imposed or carried out, the Referral Bench concludes that referral of the case of Prosecutor v. Gojko Jankovic to the authorities of Bosnia and Herzegovina should be ordered".

Background

Currently this is the sixth 11bis decision: Four cases have been referred to the authorities of Bosnia and Herzegovina (Todovic and Rasevic, Stankovic, Mejakic et al and Jankovic); one motion has been denied (Dragomir Milosevic case) and one motion has been withdrawn (Sljivancanin et al.). Four other 11bis motions are pending (Ademi and Norac, Vladimir Kovacevic, Milan and Sredoje Lukic, and Pasko Ljubicic).
