ICTY Weekly Press Briefing

Date: 15.11.2006

Time: 12:00

Registry and Chambers:

Refik Hodžić, Spokesman for Registry and Chambers, made
the following statement:

The Court of Bosnia and Herzegovina yesterday sentenced Radovan
Stanković to 16 years’ imprisonment for rapes and other crimes
against humanity committed in the Bosnian town of Foča in
1992. Stanković was the first ICTY indictee whose case was
transferred to a national court as part of Tribunal’s completion
strategy, under the Rule 11bis. Today's judgement justifies
the Tribunal's strategy of transferring cases, expertise and know-how
to the judiciaries in the region, and particularly Bosnia and
Herzegovina.

The Tribunal is dedicated to assisting local courts in conducting
war crimes trials in accordance with international standards of
fair trial and remains committed to supporting fair trials for
the perpetrators of atrocities committed during the conflicts
in the former Yugoslavia. The ICTY hopes the judiciary of Bosnia
and Herzegovina can complement the work of the Tribunal in providing
justice and trying perpetrators that will not be tried in The
Hague.

SCHEDULE:

There will be another status conference
in the Vojislav Šešelj case next Wednesday at 9:00 in courtroom
II.

The proceedings in the Milutinović
et al., Mrkšić et al., Martić, Popović et al. and
Prlić et al. cases will continue this week, although there
will be no hearing in the Prlić et al. case on Friday.

Next week, the proceedings in the
Martić case are scheduled to end with the conclusion of the
Defence case on Monday. The Mrkšić et al. case will continue
next week in the mornings in courtroom I and then move to courtroom
II at 15:00. The Milutinović et al. and Popović et al.
cases will continue Monday through Friday. The case Prlić
et al. case will continue Monday through Thursday.

Also, there has been a scheduling
order in the case of Vidoje Blagojević and Dragan Jokić.
Appeals hearings are scheduled for 5 and 6 December. Apart from
that, status conferences are to be held on 24 November in the
case of Milan Trbić, and on 4 December in the case against
Jovica Stanišić and Franko Simatović.

Office of the Prosecutor:

Anton Nikiforov, Advisor to the
Prosecutor, made no statement.

Questions:

Asked to confirm that Vojislav
Šešelj was refusing to take food offered to him by Detention Unit
(DU) staff, Hodžić stated that this was indeed the case.

In answer to a question about the arrangements
for visits by family members to Šešelj, Hodžić pointed out
that the DU had two types of visits to detainees: privileged visits
by defence counsel and consular staff which are sight-monitored
only, and visits by friends and family which the DU management
could monitor in sight and hearing if it saw fit to do so. He
added that in the case of Šešelj, the DU management took the decision
to monitor visits by his family and friends in both sight and
hearing. Hodžić also made it emphatically clear that it was
untrue that Šešelj had been prevented from seeing his family and
friends as had been reported in some media.

In response to a question as to
whether Šešelj’s medical condition was being monitored and whether
he was eating food provided from other sources, Hodžić answered
that there were mechanisms in the DU to monitor every detainee’s
health and that Šešelj’s health was being monitored. Hodžić
had no comment as to whether Šešelj was eating food obtained from
another source.

Asked whether Šešelj was refusing
medicine and what type of medicine he was receiving, Hodžić
replied that that information regarding what medicine he was taking
was confidential information to protect the privacy of detainees
and that he therefore had no comment. He added that nothing had
been observed which would indicate that Šešelj’s health was deteriorating.

Asked what the impact of Šešelj’s
current actions would be on the start of the trial, Hodžić
made it clear that only matters that were inside the scope of
the Rules of Procedure and Evidence and the Statute could have
any impact on Tribunal procedures. He added that at present there
was a scheduling order for the trial to begin on 27 November.
It was up to The Trial Chamber to bring changes to that if it
saw fit.

Nikiforov added that, although
it was not connected to Šešelj’s refusal to take food, the Prosecution
had dropped its objections to his family visits. He reiterated
that this decision been taken before Šešelj’s decision to refuse
food offered by DU staff.

A journalist asked for clarity
as to what the problem was with registering Šešelj’s legal advisors:
whether it was that Šešelj had not filed a list, or that they
did not qualify to receive legal status. Hodžić responded
that the people named on the list provided by Šešelj did not qualify
under Rule 44 of the Tribunal’s Rules of Procedure and Evidence.
He stated that the privileges that were requested, for example
privileged access to Šešelj or access to confidential documents,
were only afforded to people who qualified under Rule 44 and could
be bound by the Code of Professional Conduct. In order to receive
these privileges, legal advisers had to meet the criteria.
