Prosecution’s Appeals against provisional release dismissed by the Appeals Chamber


Today, 3 December 2004, the Appeals Chamber consisting of Judge Meron (Presiding), Judge Pocar, Judge Mumba, Judge Güney and Judge Weinberg de Roca dismissed the Prosecution Appeals against Stanisic’s and Simatovic’s provisional release in two separate Decisions.




The Appeals Chamber was not satisfied that the Prosecution had established that the Trial Chamber erred in finding that both accused be provisionally released.




Background




On 14 January 2004, Mr. Stanisic filed a Motion for provisional release. The Prosecutor filed a response opposing the Motion on 7 April 2004.




On 30 January 2004, Mr. Simatovic filed a Motion for provisional release on. The Prosecutor’s Response to the Motion was filed on 13 February 2004 opposing the Motion.




Hearings were held on both motions on 10 and 11 May and on 25 and 26 May 2004.




The Trial Chamber filed two separate Decisions on 28 July 2004 granting both Motions for provisional release. On 29 July 2004 the Prosecution filed a Motion to stay the Decisions which the Trial Chamber granted that same day.




On 6 September 2004, both accused filed an Appeal before the Appeals Chamber against the stay of Decisions on provisional release. These Appeals were dismissed by the Appeals Chamber on 29 September 2004.




The Prosecution filed two Appeals against the Decisions on provisional release on 8 October 2004.
