INDICTMENT AGAINST GORAN BOROVNICA WITHDRAWN WITHOUT PREJUDICE


Today, 22 April 2005, Judge Parker issued an Order granting the motion for leave to withdraw the indictment against Goran Borovnica without prejudice. This motion was filed by the Prosecutor on 14 April 2005 before the President of the Tribunal. The indictment against Goran Borovnica was confirmed on 13 February 1995 by Judge Karibi-Whyte and amended on 14 December 1995.


Background


In his Order Judge Parker considered that the Prosecutor presented documents indicating that the accused had been declared missing since 20 March 1995 and declared dead since 22 November 1996. Judge Parker further considered that, "while some information received by the Prosecutor suggested the possibility that the Accused might still be alive, the Prosecutor has been unable to
confirm this information, and that enquiries by the Prosecutor with the assistance of governmental agencies have failed to locate the Accused."


Judge Parker considered that it would be appropriate to withdraw the indictment without prejudice "so that should information confirming that the Accused is alive become available, the charges against the Accused could be again pursued by the relevant prosecutorial authorities."
