TRIAL CHAMBER IN RASIM DELIĆ CASE TO HOLD A HEARING IN SARAJEVO

A two day hearing in the case of Rasim Delić, the former commander of the Main Staff of the Army of the Republic of Bosnia and Herzegovina (ABiH), is scheduled to take place in Sarajevo this weekend.


The hearings will be conducted on the premises of the Court of Bosnia and Herzegovina starting on Friday 8 February at 09.00 am. The hearings are scheduled to continue for up to four days in total, concluding Monday 11 February.


The chamber will hear the testimony of Aiman Awad, who will be the last Prosecution witness to testify before the Trial Chamber in the case. The proceedings are temporarily shifting to Sarajevo on the request of the Prosecution, due to the specific circumstances of that witness, and in accordance with the Tribunal's Rules of Procedure and Evidence. All Parties to the Trial
will be present at the hearing, including the accused.


This is the second evidentiary hearing to be conducted by the Tribunal outside of its courtrooms in The Hague, the first being that of the same Trial Chamber also held in Sarajevo in September last year.


Rasim Delić is charged on the basis of command responsibility for the murder, cruel treatment and rape of captured Croat and Serb soldiers and civilians committed by El Mujahed units and other ABiH members in Travnik and Zavidovici municipalities of central Bosnia in 1993 and 1995. His trial started on 9 July 2007.


The Tribunal acknowledges the hospitality of the Court of Bosnia and Herzegovina in allowing the ICTY Trial Chamber to use its premises on this occasion. The Court of Bosnia and Herzegovina has provided assistance in a number of important support functions necessary for the hearing.
