KRSMANOVIC CASE-IT-96-19-MISC1


Trial Chamber I, presided over by Judge Jorda, will consider an application on behalf of Colonel Aleska Krsmanovic on Friday 29 March 1996 at 10.30 a.m.


The Colonel will be present at the hearing.


The motion, which was filed by counsel for Colonel Krsmanovic on 19 March 1996, requests a clarification of the Colonel's status before the Tribunal.


Submitted pursuant to Rule 54 of the Rules of Procedure and Evidence, the application notes that, following consultations between Colonel Krsmanovic and his lawyer, Mr. Igor Pantelic, Colonel Krsmanovic has "made his clear statement (. . . ) that he is not prepared to cooperate with the Prosecutor with regard to any of its actual investigations nor was he prepared to be a witness
before the Tribunal's cases".


The motion states that Colonel Krsmanovic is prepared to make a personal statement to this effect at the hearing. Alternatively, the Prosecutor may take a statement from the Colonel in the presence of his attorney.


In an Order of 20 March 1996, Judge Jorda invited the representatives of Bosnia and Herzegovina to submit an amicus curiae brief on the detention of Colonel Krsmanovic at the hearing on 29 March 1996.
